In a major decision, Government of India ने Overseas Citizenship of India (OCI) rules को और सख्त कर दिया है. अब अगर किसी भी Overseas Citizenship of India card holder को किसी गंभीर अपराध में दो साल या उससे अधिक की सजा होती है, तो उसका OCI status तुरंत रद्द हो जाएगा. यह नियम अब सिर्फ India में नहीं बल्कि worldwide लागू होगा, यानी अगर conviction किसी foreign country में भी हुई है और वो offence भारतीय कानून के अनुसार अपराध है, तो OCI cancellation होगा.
Home Ministry के नए notification के अनुसार, अगर किसी OCI card holder पर ऐसे अपराध का charge-sheet दाखिल होता है जिसका minimum punishment सात साल या उससे अधिक है, तो भी उसका Overseas Citizenship of India status खत्म किया जा सकता है – चाहे court का final verdict आया हो या नहीं.
क्यों लिया गया ये फैसला?
सरकार का कहना है कि Overseas Citizenship of India privilege है, अधिकार नहीं. इस step का मकसद है national security और law & order बनाए रखना. पहले ये rule सिर्फ OCI issue होने के पांच साल के अंदर लागू होता था, लेकिन अब ये lifetime लागू रहेगा.
किन मामलों में लागू होगा?
- अगर conviction दो साल या ज्यादा की है.
- अगर offence ऐसा है जिसका minimum सजा सात साल या ज्यादा है और उस पर charge-sheet दाखिल हुई है.
- अगर व्यक्ति किसी ऐसे activity में शामिल है जिससे भारत की sovereignty, integrity या security को खतरा है.
Experts का कहना
Legal experts मानते हैं कि ये decision एक tough deterrent है. हालांकि, presumption of innocence पर सवाल उठ सकता है क्योंकि charge-sheet stage पर भी cancellation संभव है. Courts में इसपर challenge भी आ सकता है.
Overseas Indians को क्या करना चाहिए?
अगर आप Overseas Citizenship of India card holder हैं, तो अपनी legal record और compliance clear रखें. किसी भी criminal case को lightly न लें, क्योंकि अब overseas crime भी भारत में गिना जाएगा.
